KNOW THE LAW: Not every Police officer can retain your driving license

The Ghana Institute of Management and Public Administration (GIMPA) Students’ Representative Council (SRC) Judicial Council in a flyer have described the present state of affairs of some section of the law to the Ghanaian citizenry. The GIMPA SRC Judicial Council threw more light on Regulation 47, Road Traffic Regulations, 2012 (L1.2180), explaining that not every Police Officer can retain your driving license.

“A driver is required to have his or her original driver’s license while driving and a Police Officer in uniform has the mandate to demand for your license for inspection. 

It is your duty as a driver to produce your license or any other related documents with regards to the car you are driving immediately or within 24 hours. However, unless that Police Officer is in uniform and is an Inspector or a higher rank, the Officer has no right to retain your license or documents. When an inspector retains your license or documents, the Officer is required to issue an official receipt for that retention.” It said in a flyer.
